<p class="Default"><span style="font-family: andale mono,times;">The property you are considering purchasing may be located in a development subject to the provisions of the </span><a href="http://www.premierwilliamsburgrealestate.com/agent_files/VA.%20Code%20for%20POA%20disclosure%20statement%20and%20right%20of%20cancellation.docx"><span style="font-family: andale mono,times;">Virginia Property Owner&rsquo;s Association Act</span></a><span style="font-family: andale mono,times;">.&nbsp; If it is subject to the Act then the seller is obligated to disclose that fact you in the contract and to provide you with what is known as an Association Disclosure Packet, which contains a significant amount of information and documents.&nbsp; Most importantly, under this law you have the unilateral right to terminate the contract but termination must be done correctly and timely.</span></p>
<p class="Default"><span style="font-family: andale mono,times;"> <strong>What is the Property Owner&rsquo;s Association Act?&nbsp; </strong></span><a href="http://www.premierwilliamsburgrealestate.com/agent_files/VA.%20Code%20for%20POA%20disclosure%20statement%20and%20right%20of%20cancellation.docx"><span style="font-family: andale mono,times;">The Virginia Property Owners Association Act (&ldquo;the Act&rdquo;)</span></a><span style="font-family: andale mono,times;"> is a series of laws that regulate associations that manage real estate developments that have certain characteristics, notably a subdivision declaration, restrictive covenants, dues, assessments, etc.&nbsp; The Act also requires a seller and the association to make certain disclosures to buyers.&nbsp; </span></p>
<p class="Default"><span style="font-family: andale mono,times;"> <strong>What is a property owner&rsquo;s association (POA)</strong>?&nbsp; Real estate developments often have common areas to own and maintain, architectural review boards, dues, assessments, etc.&nbsp; The tasks and duties associated with these subdivision characteristics are managed by an association of the owners.&nbsp; The association, often incorporated, may be self-managed or professionally managed.</span></p>
<p class="Default"><span style="font-family: andale mono,times;"> <strong>What is an association disclosure packet?&nbsp; </strong>The Act obligates a seller to obtain and provide to prospective purchasers a packet of information, the contents of which are specified by law, in order for a buyer to evaluate the association and the obligations, financial and otherwise, incidental to owning property subject to the association.</span></p>
<p class="Default"><span style="font-family: andale mono,times;">&nbsp; <strong>What should the disclosure packet contain?&nbsp; </strong>The Act specifies the contents of the packet.&nbsp; For example, the name of the association, pending assessments or expenditures of funds, a statement of fees including assessments, a current reserve, study report, current budget, notice as to any pending law suits against the association, insurance coverage information, a statement whether the lot and house are in violation of association rules, copy of the declaration, bylaws, and rules and regulations, minutes from any board of directors or association meetings for six months preceding, etc.&nbsp; Please see the </span><a href="http://www.premierwilliamsburgrealestate.com/agent_files/VA.%20Code%20for%20POA%20disclosure%20statement%20and%20right%20of%20cancellation.docx"><span style="font-family: andale mono,times;">statute</span></a><span style="font-family: andale mono,times;"> for a complete list.</span></p>
<p class="Default"><span style="font-family: andale mono,times;"> <strong>What are a seller&rsquo;s obligations under the Act?&nbsp; </strong>The seller is obligated to disclose whether the property is subject to the Act, and if so, to obtain the association disclosure packet, at the seller&rsquo;s expense, and to provide it to you, the buyer.&nbsp;</span></p>
<p class="Default"><span style="font-family: andale mono,times;"><strong>Can I cancel the contract if I do not approve?&nbsp; </strong>Yes!&nbsp; The Act permits a purchaser to cancel within three days of the date of receipt of the disclosure packet.&nbsp; Bear in mind that unless the contract specifies to the contrary, the receipt of the packet by your agent or your agent&rsquo;s firm may trigger the three-day window.</span></p>
<p class="Default"><span style="font-family: andale mono,times;"> <strong>When can I cancel?&nbsp; </strong>You may terminate the contract any time prior to settlement if you have not been notified that the association disclosure packet will not be available and the association disclosure packet is not delivered to you.&nbsp; In addition, you may cancel within three days after receiving the association disclosure packet if the association disclosure packet or notice that the association disclosure packet will not be available is hand delivered or delivered by electronic means and a receipt obtained; or within six days after the postmark date if the association disclosure packet or notice that the association disclosure packet will not be available is sent to you by United States mail.</span></p>
<p class="Default"><span style="font-size: 10pt;"><span style="font-family: andale mono,times;"> <strong>How do I can cancel?&nbsp; </strong>You should have your real estate agent or your attorney assist you with cancellation, but briefly you need to provide written notice of the termination and send it to the seller in the statutorily prescribed manner (a copy of the statute is provided).</span></span></p>

<p>&nbsp;VHDA actually offers the USDA program as one of their alternatives, but the USDA is SO much better than the VHDA FHA Plus that most folks think about when they think VHDA.&nbsp;&nbsp; We do both, but I only use the FHA Plus when the USDA is not available or the property does not qualify.&nbsp; It is so much better for the client.</p>
<p>The advantages of USDA over the VHDA FHA Plus:&nbsp;</p>
<ul>
<li>Higher maximum household income</li>
<li>Lower total monthly payment&nbsp;&nbsp; (due to no mortgage insurance requirement)</li>
<li>Can finance in closing costs and pre-paids into the loan, up to the appraised value</li>

Getting the loan that suits your situation at the best possible price and terms makes homebuying easier and more affordable. Here are seven ways to boost your credit score so you can do just that.</p>

<h3>1. Know your credit score</h3>
<p>Credit scores range from 300 to 850, and the higher, the better. They&rsquo;re based on whether you&rsquo;ve paid personal loans, car loans, credit cards, and other debt in full and on time in the past. You&rsquo;ll need a score of at least 620 to qualify for a home loan and 740 to get the best interest rates and terms.&nbsp;</p>
<p>You&rsquo;re entitled to a free copy of your credit report annually from each of the major credit-reporting bureaus, <a class="external" href="http://www.equifax.com/" target="_blank">Equifax</a>, <a class="external" href="http://www.experian.com/" target="_blank">Experian</a>, and <a class="external" href="http://www.transunion.com/" target="_blank">TransUnion</a>. <h3>2. Correct errors on your credit report</h3>
<p>If you find mistakes on your credit report, write a letter to the credit-reporting agency explaining why you believe there&rsquo;s an error. Send documents that support your case, and ask that the error be corrected or removed. Also write to the company, or debt collector, that reported the incorrect information to dispute the information, and ask to be copied on any materials sent to credit-reporting agencies.</p>
<h3>3. Pay every bill on time</h3>
<p>You may be surprised at the damage even a few late payments will have on your credit score. The easiest way to make a big difference in your credit score without altering your spending habits is to diligently pay all your bills on time. You&rsquo;ll also save money because you&rsquo;ll keep the money you&rsquo;ve been spending on late fees. Credit card or mortgage companies probably won&rsquo;t report minor late payments, those less than 30 days overdue, but you&rsquo;ll still have to pay late fees.</p>

If you can&rsquo;t do that, pay as much over your required minimum payment as possible to begin whittling away the debt. <h1><span style="font-size: 12pt;"><span style="color: #808080;">By knowing how much mortgage you can handle, you can ensure that home ownership will fit in your budget.</span></span></h1>
<p>Homeownership should make you feel safe and secure, and that includes financially. Be sure you can afford your home by calculating how much of a mortgage you can safely fit into your budget.<br /><br />Instead of just taking out the biggest mortgage a lender qualifies you to borrow, consider how much you want to pay each month for housing based on your financial and personal goals.<br /><br />Think ahead to major life events and consider how those might influence your budget. Do you want to return to school for an advanced degree? Will a new child add day care to your monthly expenses? Does a relative plan to eventually live with you and contribute to the mortgage?<br /><br />Still not sure how much you can afford? You can use the same formulas that most lenders use, or try another of these traditional methods for estimating the amount of mortgage you can afford.</p>
<h2>1. The general rule of mortgage affordability</h2>
<p>As a rule of thumb, you can typically afford a home priced two to three times your gross income. If you earn $100,000, you can typically afford a home between $200,000 and $300,000.<br /><br />To understand how that rule applies to your particular financial situation, prepare a family budget and list all the costs of homeownership, like property taxes, insurance, maintenance, utilities, and community association fees, if applicable, as well as costs specific to your family, such as day care costs.</p>
<h2>2. Factor in your downpayment</h2>
<p>How much money do you have for a downpayment? The higher your downpayment, the lower your monthly payments will be. If you put down at least 20% of the home's cost, you may not have to get private mortgage insurance, which costs hundreds each month. That leaves more money for your mortgage payment.</p>
<p>The lower your downpayment, the higher the loan amount you'll need to qualify for and the higher your monthly mortgage payment.</p>
<h2>3. Consider your overall debt</h2>
<p>Lenders generally follow the 28/41 rule. Your monthly mortgage payments covering your home loan principal, interest, taxes, and insurance shouldn't total more than 28% of your gross annual income. Your overall monthly payments for your mortgage plus all your other bills, like car loans, utilities, and credit cards, shouldn't exceed 41% of your gross annual income.<br /><br />Here's how that works. If your gross annual income is $100,000, multiply by 28% and then divide by 12 months to arrive at a monthly mortgage payment of $2,333 or less. Next, check the total of all your monthly bills including your potential mortgage and make sure they don't top 41%, or $3,416 in our example.</p>
<h2>4. Use your rent as a mortgage guide</h2>
<p>The tax benefits of homeownership generally allow you to afford a mortgage payment-including taxes and insurance-of about one-third more than your current rent payment without changing your lifestyle. So you can multiply your current rent by 1.33 to arrive at a rough estimate of a mortgage payment.<br /><br />Here's an example. If you currently pay $1,500 per month in rent, you should be able to comfortably afford a $2,000 monthly mortgage payment after factoring in the tax benefits of homeownership.<br /><br />However, if you're struggling to keep up with your rent, consider what amount would be comfortable and use that for the calcuation instead.<br /><br />Also consider whether or not you'll itemize your deductions. If you take the standard deduction, you can't also deduct mortgage interest payments. Home sales and home prices are always interesting and very useful information. Taken with a grain a salt, checking recent sales and comparing properties is as close as you can get to a "quarterly statement" on what could be your largest investment : your home. It is funny as I always hear people saying that they think that they are being "nosy"&nbsp;when they are curious as to what their neighbor's home sold for, when in truth, you really should know the values around you. While you may not being selling your home right now, knowing the value of your home is just as important as knowing the value of your stocks/bonds or money market funds. The values of all certainly fluctuate but it is always good to know where you stand.</p>
<p>&nbsp;&nbsp; In our little corner of the world we have several items to contend with: the general state of the economy and housing, the end of the government tax credits and, finally, more specific to Ford's Colony is the announcement on April 3, 2010 that the country club had filed for Chapter 11 bankruptcy protection. I always emphasize that the country club and the home owners association of Ford's Colony&nbsp;are two VERY DIFFERENT and UNIQUE entities.&nbsp; The HOA in Ford's Colony is alive and well and functioning as a very strong and healthy congruent group.&nbsp;</p>
<p>&nbsp;I took sales in Ford's Colony for the prior 12 months (June 2009- June 2010) and&nbsp;studied &nbsp;what had sold, how much had sold&nbsp;and compared those sales prices to&nbsp; the assessed values.( I always tell folks that assessed value and market value are two different animals, however, it is useful to see how those two figures compare.) SO for purposes of not getting too long on evaluating numbers, I will divide my findings into a couple of blog posts. There are few folks that enjoy looking at numbers we all just want the bottom line!&nbsp;&nbsp;&nbsp;</p>
<p><span style="color: #000000;">So the first question <strong>how were sales during the past 12 months and what was the impact on sales from the April 3 country club bankruptcy filing?</strong> </span>&nbsp;&nbsp;</p>
<p>&nbsp;Grits and Grasshoppers:</p>
<p>The months supply of inventory in Ford's Colony went from 28.8 months of inventoryin 2009&nbsp;to 24.8 months of inventory in 2010. So- while not a fun number to see 2010 IS better than 2009. Here is the most interesting statistic from the Months Supply of Inventory: during the month of April 2010, the months supply of inventory declined to 11.4 and then in May 2010 it declined to 10.5. In April there were 12 homes that went under contract and in May there were also 12 homes that went under contract. June saw a huge drop to 5 homes under contract. Those are VERY important numbers as the country club announcement of the bankruptcy protection plan was made on April 3! The numbers immediately following that announcement were the best of the entire 12 month time period. We do have to consider the tax credit stimulus during those months also which, in the short-term anyway, certainly gave a jolt of energy to sales. The tax credit ended April 30,2010. Home buyers had to be under contract by the end of April to qualify. We saw a lot of buyers rushing at the end of the month to be under contract which resulted in a 'trickle around' effect in May as those month-end April sellers then became our May buyers.</p>
<p><em>Bottom line? Sales in Ford's Colony seem to be more affected by the TAX credit ending versus any perceived issues with the&nbsp;country club. This is good news in and of itself.&nbsp; &nbsp;</em></p>

Examples of some of the clubs include: many bridge groups, Colony Wine &amp; Dine, Chess Club, bowling, Colony Kids, Afternoon Artists, Pilates Group,Photography, Travel Club, Mah Jongg, Fly Fishing Club, Tai Chi, Model Railroad Club, Theater Club, swim team, and the list goes on! There is a club or group that has been started for just about every hobby/interest.</p>

The milestone is a sign that the performance of theGSEs&rsquo; loan portfolio is improving and loss mitigation efforts to turn defaults around are having an impact, considering Freddie endured a long three-year stretch of delinquency increases up until <a href="http://www.dsnews.com/articles/freddie-mac-reports-first-delinquency-decline-in-three-years-2010-05-04" target="_blank">March of this year</a>.</p>
<p>According to Freddie Mac&rsquo;s <a href="http://www.freddiemac.com/investors/volsum/pdf/0610mvs.pdf" target="_blank">monthly summary report</a> released Friday, the number of single-family mortgages at least three months past due or in foreclosure as of the end of June stood at 3.96 percent. That&rsquo;s down from 4.06 percent the month before and a high of 4.20 percent as recently as February.</p>
<p>Freddie noted in its explanation of the numbers that because the company includes loans in the trial period of the Home Affordable Modification Program (HAMP) as delinquent in its statistical reporting, this treatment results in a temporary rise in the delinquency rate until the modifications become effective and are removed from delinquent status.</p>
<p>The GSEs&rsquo; data show that 21,367 official loan modifications were completed on Freddie-owned mortgages in June. During the first six months of the year, servicers have permanently modified 93,568 distressed loans for the mortgage giant.</p>
<p>The volume of effective modifications impacts the GSE&rsquo;s reported delinquency rate, which is an indication that past due numbers will continue to improve as more borrowers complete their HAMP trials and either move into permanent mods or pursue other foreclosure alternatives.</p>
<p>Freddie&rsquo;s multifamily delinquency rate also dropped in June, sliding from 0.32 percent in May to 0.28 percent last month.</p>
<p>The company&rsquo;s total mortgage portfolio shrank at an annualized rate of 0.9 percent in June, ending the month with a balance of $2.22 trillion. Mortgage-related investments declined by an annual rate of 13.8 percent, or $8.6 billion, in June to $739.5 billion.</p>
<p>Freddie Mac spokesman Michael Cosgrove explained to <em>Reuters</em>, &ldquo;We have been in a low-growth mode in our retained portfolio for much of this year, with most of the growth in portfolio related to purchase of seriously delinquent loans from pools backing our PC securities.&rdquo;</p>
<p>Both GSEs announced in February that they would buy back all home loans from investors that were at least 120-days past due in order to reduce capital expenditures. Freddie Mac has repurchased approximately $73 billion in seriously past due mortgages from securities pools.</p>

<p>What is owner&rsquo;s title insurance?</p>
</strong>
<p>Title insurance is insurance, just like any other insurance, except that here it insures against defects in ownership. A policy of title insurance is like a pre‐paid legal agreement: the title insurer will provide legal defense against challenges to the buyer&rsquo; insured title (dependent, of course, upon the type of policy coverage) and will reimburse the buyer financially for losses due to covered defects in the buyer&rsquo; ownership rights. An owner'spolicy insures buyers that the title to the real estate is free from all defects, liens and&nbsp;encumbrances except those that are listed as exceptions in the policy or are excluded from the policy&rsquo;s coverage. It also covers losses and damages suffered if the title is unmarketable. The policy also provides coverage for loss if there is no right of access to the land. These are the basic coverages and an enhanced residential owner's policy can be purchased that cover additional items of loss.</p>
<p><strong>If I get owner&rsquo;s title insurance am I protected?</strong></p>
<p>About as protected as you can possibly get, particularly with an enhanced title insurance policy. I highly recommend it. If you ever have a loan officer or lender tell you that an owner&rsquo;s policy is not needed (so you can save some money) you ought to ask them why then they require you to pay for a (lender&rsquo;s) policy to protect them. If you ever have a realestate agent tell you an owner&rsquo;s policy is not needed you ought to get that in writing so you can later sue them (does not need to be in writing, it&rsquo;s just that the evidence of the bad advice is better).</p>

<p><strong>Doesn&rsquo;t the lender&rsquo;s title insurance policy protect me?</strong></p>
<p>No. It is called a lender&rsquo;s policy because the lender is the insured, not the buyer, which means the buyer has no rights whatsoever under that policy. Many people think that if a lender&rsquo;s policy pays the note will be paid and so the loss will not be that great and so they are somewhat protected. This is misguided and wrong for several reasons. First, an owner is not compensated for the equity in the property. Second, even if the lender&rsquo;s policy &ldquo;pays off&rdquo; what in effect happens is that the title insurance company will buy the note from thelender. So even then the buyer is not helped because the title insurance company steps into the shoes of the lender &ndash; who has an unpaid note from the buyer &ndash; and they can insist a buyer pay regardless whether the collateral for the loan has been lost or not. Besides, a lender&rsquo;s policy only insures the deed of trust securing the note, not the fee simple title a buyer would be concerned about, and so there are many different coverage provisions is not compensated for the equity in the property.&nbsp;</p>
